KENYATAAN MEDIA 20TH MARCH 2013

PENGKHIANATAN TERHADAP KEPERCAYAAN RAKYAT OLEH KETUA MENTERI SARAWAK PEHIN SERI ABDUL TAIB MAHMUD.

Merujuk kepada artikel yang dipaparkan di laman THE MALAYSIAN INSIDER dan GLOBAL WITNESS (http://www.globalwitness.org ) bertarikh 15 hb March 2013.

Kami rakyat Sarawak amat terkejut terhadap video pendedahan yang dilakukan oleh kedua-dua laman internet berikut. Isu yang sangat besar ini berkenaan dengan pengakuan secara langsung oleh beberapa individu yang dikenali sangat rapat dengan Ketua Menteri Sarawak Abdul Taib Mahmud.

Untuk makluman semua isu ini bukanlah satu isu yang baru bagi kami kerana sebelum ini pelbagai pendedahan juga telah dilakukan terhadap Skandal Salahguna Kuasa peringkat tertinggi Kerajaan Barisan Nasional Sarawak dan hero utamanya tidak lain dan tidak bukan ialah Ketua Menteri sendiri.

Namun kali ini perbezaannya ialah, Individu-individu yang terlibat dalam klip video ‘Pendedahan Tak Sengaja’ ini ialah dari kalangan ahli keluarganya sendiri yang kita tahu sangat rapat dengan Ketua Menteri Abdul Taib Mahmud iaitu Fatimah Binti Tun Abdul Rahman Yaacob, Norlia Binti Tun Abdul Rahman Yaacub iaitu anak kepada mantan Ketua Menteri Sarawak Tun Abdul Rahman Yaakub. ( bapa saudara Abdul Taib Mahmud )

Individu lain yang dipaparkan didalam video ini adalah En Huang Lung Ong yang dipercayai mewakili Huang & Co. Advocates dan En Alvin Chong dari Alvin Chong & Partner Advocates. Mereka ini merupakan dikalangan peguam yang mewakili Kerajaan Negeri Sarawak.

ISU BESAR

Isu besar disini adalah pengakuan secara langsung oleh 4 individu yang sangat rapat dengan Ketua Menteri Abdul Taib Mahmud terhadap perancangan mereka untuk mengkaut keuntungan dengan menjual syarikat Ample Agro ( syarikat milik keluarga Tun Rahman Yaakub ) yang memiliki tanah berjumlah 200,000 hektar yang menurut mereka adalah hasil dari pemberian Ketua Menteri Abdul Taib Mahmud.

Tanah yang dimaksudkan ini sedang dihuni oleh masyarakat pribumi Sarawak sejak berdekad lalu dan kini telah menjadi hak milik keluarga Abdul Taib melalui perancangan terperinci yang dilakukan oleh pegawai-pegawai kerajaan.

Video tersebut telah menghuraikan serta menjawab persoalan yang selama ini berlegar di minda rakyat iaitu :

  1. Bagaimana keluarga Taib Mahmud mampu memiliki harta kekayaan sebegitu banyak yang dianggarkan sebanyak RM65 billion sebelum ini. Adakah tanah ratusan ribu hektar ini ( dianggarkan sebesar 2 kali ganda Negara Hong Kong ) di Sarawak termasuk dalam jumlah tersebut.
  2. Bagaimana Datuk Abu Bekir Taib mampu memiliki kekayaan luar biasa seperti yang didedahkan didalam Mahkamah Syariah berikutan kes tuntutan cerai bekas isterinya Shahnaz.
  3. Bagaimana tanah adat dirampas melalui perancangan teliti yang dilakukan oleh penjawat awam demi untuk memuaskan hati Ketua Menteri Sarawak.

Video ini juga secara langsung telah meberitahu kita secara terperinci penglibatan agensi-agensi dibawah pentadbiran Kerajaan Barisan Nasional yang berkhidmat untuk memuaskan nafsu memperkayakan keluarga oleh Abdul Taib Mahmud.

Bagaimana rakusnya Ketua Menteri Sarawak mengkaut hasil bumi untuk memperkayakan diri dan kroni walhal pada masa yang sama membiarkan majority rakyat Sarawak hidup dalam serba kekurangan termasuk ketiadaan bekalan api dan air bersih disebahagian kawasan luar bandar sejak puluhan tahun dahulu..

Dikala rakyat Sarawak dibiarkan dalam serba kekurangan malah menjadi penerima bantuan E-Kasih tertinggi di Malaysia, mereka memonopoli ekonomi negeri seolah-olah hanya mereka saja yang berhak makan daging sementara rakyat biasa dibiarkan makan pasir.

APA TINDAKAN PENGUASA?

Umum mengetahui bahawa banyak laporan Polis dan SPRM telah dibuat sejak tahun 2002 terhadap skandal salahguna kuasa Abdul Taib Mahmud dan barisan pimpinan Barisan Nasional Sarawak, namun sehingga sekarang tahun 2013 tiada pendakwaan yang dilakukan.

Adakah penguasa memerlukan sehingga 11 tahun untuk mengumpul bukti sebelum membuat pendakwaan terhadap pimpinan Barisan Nasional yang terlibat? Jika benar ketiadaan bukti maka kami harap dengan pendedahan beberapa individu tadi mampu membuahkan titik mula untuk SPRM dan POLIS memulakan siasatan.

Kelemahan penguasa menangani isu-isu begini telah menjatuhkan maruah Jabatan-jabatan yang terlibat. Mereka dilihat seolah-olah menjadi robot dan ‘remote control’nya berada ditangan Ketua Menteri Sarawak.

KESIMPULAN

  1. Mendesak Abdul Taib Mahmud berundur dari jawatan yang beliau sandang dengan kadar segera untuk memberi laluan kepada siasatan pihak penguasa.
  2. Mendesak Peguam Negara untuk membekukan asset keluarga Abdul Taib Mahmud didalam Negara sehingga proses siasatan terhadap beliau selesai.
  3. Mendesak Suruhanjaya Pencegah Rasuah Malaysia dan Polis Diraja Malaysia mengambil tindakan yang difikirkan perlu untuk membuka kertas siasatan segera hasil pendedahan bukti terbaru ini keatas Abdul Taib Mahmud dan keluarganya.
  4. Memohon Satu Suruhanjaya Bebas untuk meneliti dan menyiasat pegawai-pegawai tinggi Jabatan Tanah Dan Survey Sarawak.
  5. Mendesak Abdul Taib Mahmud untuk mengambil tindakan saman terhadap individu yang terlibat jika beliau tidak bersalah.

Lahad Datu Statement from Pakatan Leadership

MEDIA RELEASE MARCH 4, 2013

THE FEDERAL GOVERNMENT SHOULD NOW PRIORITISE ON GUARANTEEING OUR TERRITORIAL INTEGRITY AND SECURITY

Any leader of any country must defend his nation’s sovereignty and the security of his people. 

Failing to do so is a grave betrayal of the people’s trust in its government. Therefore, Pakatan Rakyat urges the present national leadership to do that which is required of them, to defend our land and never to compromise the safety of each and every Malaysian, and the test of those principles is ongoing in and around Sabah’s Lahad Datu and Semporna with the escalating violence brought by armed foreigners. 

In Lahad Datu two of members of our security forces have lost their lives, while the latest acts in Semporna have claimed six of our men in uniform. We express our sincere condolences to these men’s families and may God bless them for they have given the highest sacrifice for a grateful nation.

Pakatan Rakyat calls on all Malaysians to show unreserved support to our security forces, both the police and military. And pray that they remain safe while defending our nation and its people from harm.

Pakatan realises the recent incidents in Sabah raise concern and fear, but we urge the public to remain calm and not to act rashly and hurt their fellow countrymen. 

The coalition takes this opportunity to restate its confidence in the capacity and capability of our security forces to protect our country’s sovereignty.

We are disappointed with the weak leadership show by the federal government whose responsibility is to keep Malaysia’s security intact.

While we are convinced that national security transcends political divides and all citizens must support the security forces’ efforts, it does not abrogate the federal leadership for its lax treatment of the whole affair.

This leadership has failed to pass accurate information quickly so that the public is aware of what is happening, an error which has caused rumour-mongering to be rife.

We understand that the government is investigating the leader of opposition to over the armed intrusions in Sabah. We would like to state categorically that Dato’ Seri Anwar Ibrahim is in no way involved with the escalation of violence in Sabah nor the cause of it.

The Sabah intrusion is now into its fourth week (Day 23) — fourth day of hostilities — and the federal leadership appears not to have a clear plan to overcome the violation of our sovereign territory, or to stop any further intrusions. Instead Putrajaya is irresponsibly trying to avert the eyes of the people from its own role.

It is time the federal government realises its jobs is to defend and protect Malaysia, its people and the warriors on the frontline.

Pakatan urges for an immediate meeting between the leadership of our coalition and the prime minister, home minister and defence minister, followed by a special sitting of Parliament to discuss the intrusion.

We strongly demand Putrajaya stops finger-pointing at others especially Pakatan Rakyat and never to betray the trust of the Malaysian people.

DATO’ SERI NAJIB RAZAK SEWAJARNYA MENUMPUKAN USAHA MEMASTIKAN KEDAULATAN WILAYAH NEGARA, KESELAMATAN RAKYAT SABAH DAN ANGGOTA PASUKAN KESELAMATAN

Setiap pimpinan mana-mana negara sekalipun bertanggungjawab mempertahan kedaulatan wilayah negara, keselamatan rakyat dan anggota pasukan keselamatan.

Kegagalan mempertahankan kedaulatan negara dan keselamatan rakyat merupakan satu pengkhianatan serta menodai amanah rakyat. Justeru Pakatan Rakyat berhasrat mengingatkan pimpinan negara agar tegas mempertahankan kedaulatan wilayah negara dan tidak alpa memastikan keselamatan setiap rakyat Malaysia, terutamanya di Sabah ekoran dari insiden pencerobohan sekumpulan bersenjata warga asing di sekitar Lahad Datu serta Semporna. Setiap inci tanah Sabah dan keselamatan rakyatnya wajib dipertahankan.

Pencerobohan di Lahad Datu telah mengorbankan dua nyawa perwira negara manakala insiden terbaru di Semporna pula mengorbankan enam nyawa perwira negara. Kita merakamkan ucapan takziah buat keluarga mereka dan rakyat Sabah serta berdoa moga roh mereka dicucuri rahmat.

Pakatan Rakyat juga mengajak seluruh rakyat Malaysia untuk tetap teguh mendokong pasukan keselamatan, samada dari pihak polis atau tentera. Kita berdoa moga mereka kekal selamat serta bersemangat mempertahankan negara dan rakyat Malaysia dari ancaman penceroboh.

Pakatan Rakyat sedar keadaan mutakhir di Sabah sememangnya menimbulkan kebimbangan, akan tetapi kita menyeru agar orang ramai tetap bertenang dan tidak mengambil tindakan terburu-buru atau menyebarkan berita-berita fitnah yang boleh menimbulkan keresahan. Pakatan Rakyat ingin menyatakan dengan jelas keyakinan kita terhadap kecekapan dan kebolehan anggota pasukan keselamatan. Mereka pastinya dapat menjalankan tugas dengan profesional sekiranya diberi kebebasan bertindak tanpa sebarang campurtangan politik.

Sehingga kini, kita merasa kesal dan kecewa dengan sikap kepimpinan negara yang tidak mempamerkan kewibawaan dan iltizam dalam menyelesaikan masalah ini. Pimpinan negara juga gagal menyalurkan maklumat tepat, cepat dan telus serta memberikan penjelasan terhadap apa yang berlaku kepada umum sehingga menyebabkan khabar angin tersebar luas.

Pakatan Rakyat menggesa supaya isu ini tidak dijadikan arena tuduh-menuduh dan sewajarnya kepimpinan negara memberi tumpuan kepada isu keselamatan negara serta tidak mengalihkan pandangan rakyat dari kelemahan mereka. Sewajarnya mereka menyedari, keutamaan adalah demi mempertahankan kedaulatan negara, keselamatan rakyat dan perwira negara yang bertungkus lumus di perbatasan.

Pakatan Rakyat menuntut agar segera diadakan satu sidang khas Parlimen bagi membincangkan isu pencerobohan ini serta demi untuk mendapatkan gambaran sebenar insiden yang tercetus di Sabah. Kita juga berhasrat mengadakan satu persidangan meja bulat di antara pimpinan Pakatan Rakyat dengan pimpinan kerajaan dalam usaha untuk mencapai muafakat bersama berhubung isu ini.

Don’t Harm Sultan’s Men, Nur Warns Malaysia

MANILA, Philippines — Moro National Liberation Front (MNLF) founding Chairman Nur Misuari yesterday appealed to Malaysia to settle the Sabah standoff peacefully and warned that his group will come to the aid of Sultan Jamalul Kiram III’s followers if blood spills.

“I hope they will not harm them. They (Kiram’s followers) are our brothers. If one drop of their blood is spilled, we might be forced to come to their aid,” Misuari said.

“Please don’t touch them, give them a friendly and brotherly treatment,” Misuari appealed.

Misuari was in Zamboanga City yesterday for the MNLF leadership meeting, which he said was attended by some 2,000 leaders from across Mindanao to discuss various issues facing the Bangsamoro people.

When he was in Jolo, Sulu, over the week, Misuari said that what he heard was that the group of the Crown Prince Rajah Muda Agbimuddin Kiram, younger brother of Kiram, crossed the sea to the island because they were allegedly promised to be settled in Sabah by Prime Minister Dato Seri Haji Mohammad Najib bin Tun Haji Addul Razak.

Misuari appealed to the prime minister to exercise prudence in dealing with the people of the sultan.

“This should be handled by cooler heads,” he said, adding it would also be good to await the coming election in April in Malaysia to see who will be the new prime minister.

Misuari also said the group of Rajah Muda could have gone to Sabah to show their impatient over their claim.

Meanwhile, an ally of Kiram appealed to the Malaysian government yesterday to extend a brotherly Islamic tolerance to the Moro group still holed up in Lahad Datu, Sabah, Malaysia.

Abraham Julpa Idjirani, secretary general of the sultanate and spokesperson of Kiram III, spoke with the Manila Bulletin Thursday.

On the news report about a Friday (today) deadline said to have been issued by Malaysia for the group to leave Sabah, he did not respond specifically about it.

Rather, he reiterated that the rajah muda and his followers will not pull out from their journey home to Sabah.

“I just spoke five minutes ago to the aide-de-camp of the crown prince and also with his son. They told me they are doing fine,” said Idjirani at about 2:05 p.m. Thursday.

As he acknowledged the tolerance shown by the government of Malaysia to the Moro group who sailed to Lahad Datu on February 11, in exercise of their proprietary rights over the oil-rich island.

“We want to thank Malaysia for being tolerant to the sultan’s people,” he said.

On the other hand, he appealed to Malaysia for more tolerance to the brother Muslims.

“We appeal to Malaysia to be more patient and prolong their Islamic tolerance to their fellow Muslims,” said Idjirani.

He said in Islam, forcing people to go hungry is un-Islamic, referring to the Malaysia security forces’ blockade of food supply for the rajah muda and his group.

It started Wednesday, he said.

Idjirani said depriving food to people is also a violation of human rights enshrined in the United Nations.

Kiram III sent his brother and their people to Sabah on what they described as a journey home, crossing the sea from Simunul in Tawi-Tawi.

He said they went there peacefully to stay and claim what is rightfully the Sultanate of Sulu’s ancestral domain.

Meanwhile, the Philippine military has deployed at least six ships and an aircraft near the border of the Philippines and Malaysia in what a Navy official describe as an operation to deescalate the tension in the Sabah standoff.

Lieutenant Commander Gregory Favic, spokesman of the Philippine Navy, said they have started conducting the border patrol on February 12, or right after the news of the standoff in Sabah broke out.

Revisit : 1st Statutory Declaration by PI Balasubramaniam

STATUTORY DECLARATION

I, Balasubramaniam a/l Perumal a Malaysian Citizen of full age and residing at [deleted] do solemly and sincerely declare as follows :-

1. I have been a police officer with the Royal Malaysian Police Force having jointed as a constable in 1981 attached to the Police Field Force. I was then promoted to the rank of lance Corporal and finally resigned from the Police Force in 1998 when I was with the Special Branch.

2. I have been working as a free lance Private Investigator since I left the Police Force.

3. Sometime in June or July 2006, I was employed by Abdul Razak Baginda for a period of 10 days to look after him at his office at the Bangunan Getah Asli, Jalan Ampang between the hours of 8.00 a.m. to 5.00 p.m each working day as apparently he was experiencing disturbances from a third party.

4. I resigned from this job after 2 ½ days as I was not receiving any proper instructions.

5. I was however re-employed by Abdul Razak Baginda on the 05-10-2006 as he had apparently received a harassing phone call from a Chinese man calling himself ASP Tan who had threatened him to pay his debts. I later found out this gentleman was in fact a private investigator called Ang who was employed by a Mongolian woman called Altantuya Shaaribuu.

6. Abdul Razak Baginda was concerned that a person by the name of Altantuya Shaaribuu, a Mongolian woman, was behind this threat and that she would be arriving in Malaysia very soon to try and contact him.

7. Abdul Razak Baginda informed me that he was concerned by this as he had been advised that Altantuya Shaaribuu had been given some powers by a Mongolian ‘bomoh’ and that he could never look her in the face because of this.

8. When I enquired as to who this Mongolian woman was, Abdul Razak Baginda informed me that she was a friend of his who had been introduced to him by a VIP and who asked him to look after her financially.

9. I advised him to lodge a police report concerning the threatening phone call he had received from the Chinese man known as ASP Tan but he refused to do so as he informed me there were some high profile people involved.

10. Abdul Razak Baginda further told me that Altantuya Shaaribuu was a great liar and good in convincing people. She was supposed to have been very demanding financially and that he had even financed a property for her in Mongolia.

11. Abdul Razak Baginda then let me listen to some voice messages on his handphone asking him to pay what was due otherwise he would be harmed and his daughter harassed.

12. I was therefore supposed to protect his daughter Rowena as well.

13. On the 09.10.2006 I received a phone call from Abdul Razak Baginda at about 9.30 a.m. informing me that Altantuya was in his office and he wanted me there immediately. As I was in the midst of a surveillance, I sent my assistant Suras to Abdul Razak Baginda’s office and I followed a little later. Suras managed to control the situation and had persuaded Altantuya and her two friends to leave the premises. However Altantuya left a note written on some Hotel Malaya note paper, in English, asking Abdul Razak Baginda to call her on her handphone (number given) and wrote down her room number as well.

14. Altantuya had introduced herself to Suras as ‘Aminah’ and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.

15. These 3 Mongolian girls however returned to Abdul Razak Baginda’s office at the Bangunan Getah Asli, Jalan Ampang again, the next day at about 12.00 noon. They did not enter the building but again informed Suras that they wanted to meet Aminah’s boyfriend, Abdul Razak Baginda.

16. On the 11.10.2006, Aminah returned to Abdul Razak Baginda’s office on her own and gave me a note to pass to him, which I did. Abdul Razak Baginda showed me the note which basically asked him to call her urgently.

17. I suggested to Abdul Razak Baginda that perhaps it may be wise to arrange for Aminah to be arrested if she harassed him further, but he declined as he felt she would have to return to Mongolia as soon as her cash ran out.

18. In the meantime I had arranged for Suras to perform surveillance on Hotel Malaya to monitor the movements of these 3 Mongolian girls, but they recognized him. Apparently they become friends with Suras after that and he ended up spending a few nights in their hotel room.

19. When Abdul Razak Baginda discovered Suras was becoming close to Aminah he asked me to pull him out from Hotel Malaya.

20. On the 14.10.2006, Aminah turned up at Abdul Razak Baginda’s house in Damansara Heights when I was not there. Abdul Razak Baginda called me on my handphone to inform me of this so I rushed back to his house. As I arrived, I noticed Aminah outside the front gates shouting “Razak, bastard, come out from the house”. I tried to calm her down but couldn’t so I called the police who arrived in 2 patrol cars. I explained the situation to the police, who took her away to the Brickfields police station.

21. I followed the patrol cars to Brickfields police station in a taxi. I called Abdul Razak Baginda and his lawyer Dirren to lodge a police report but they refused.

22. When I was at the Brickfields police station, Aminah’s own Private Investigator, one Mr. Ang arrived and we had a discussion. I was told to deliver a demand to Abdul Razak Baginda for USD$500,000.00 and 3 tickets to Mongolia, apparently as commission owed to Aminah from a deal in Paris.

23. As Aminah had calmed down at this stage, a policewoman at the Brickfields police station advised me to leave and settle the matter amicably.

24. I duly informed Abdul Razak Baginda of the demands Aminah had made and told him I was disappointed that no one wanted to back me up in lodging a police report. We had a long discussion about the situation when I expressed a desire to pull out of this assignment.

25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that :-

25.1 He had been introduced to Aminah by Datuk Seri Najib Tun Razak at a diamond exhibition in Singapore.
25.2 Datuk Seri Najib Tun Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that [deleted by nat out of respect to the family of the deceased].
25.3 Datuk Seri Najib Tun Razak wanted Abdul Razak Baginda to look after Aminah as he did not want her to harass him since he was now the Deputy Prime Minister.
25.4 Datuk Seri Najib Tun Razak, Abdul Razak Baginda and Aminah had all been together at a dinner in Paris.
25.5 Aminah wanted money from him as she felt she was entitled to a USD$500,000.00 commission on a submarine deal she assisted with in Paris.

26. On the 19.10.2006, I arrived at Abdul Razak Baginda’s house in Damansara Heights to begin my night duty. I had parked my car outside as usual. I saw a yellow proton perdana taxi pass by with 3 ladies inside, one of whom was Aminah. The taxi did a U-turn and stopped in front of the house where these ladies rolled down the window and wished me ‘Happy Deepavali’. The taxi then left.

27. About 20 minutes later the taxi returned with only Aminah in it. She got out of the taxi and walked towards me and started talking to me. I sent an SMS to Abdul Razak Baginda informing him “Aminah was here”. I received an SMS from Razak instructing me “To delay her until my man comes”.

28. Whist I was talking to Aminah, she informed me of the following :-
28.1 That she met Abdul Razak Baginda in Singapore with Datuk Seri Najib Tun Razak.
28.2 That she had also met Abdul Razak Baginda and Datuk Seri Najib Tun Razak at a dinner in Paris.
28.3 That she was promised a sum of USD$500,000.00 as commission for assisting in a Submarine deal in Paris.
28.4 That Abdul Razak Baginda had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem it.
28.5 That her mother was ill and she needed money to pay for her treatment.
28.6. That Abdul Razak Baginda had married her in Korea as her mother is Korean whilst her father was a Mongolian/Chinese mix.
28.7 That if I wouldn’t allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Datuk Seri Najib Tun Razak.

29. After talking to Aminah for about 15 minutes, a red proton aeroback arrived with a woman and two men. I now know the woman to be Lance Corporal Rohaniza and the men, Azilah Hadri and Sirul Azahar. They were all in plain clothes. Azilah walked towards me while the other two stayed in the car.

30. Azilah asked me whether the woman was Aminah and I said ‘Yes’. He then walked off and made a few calls on his handphone. After 10 minutes another vehicle, a blue proton saga, driven by a Malay man, passed by slowly. The drivers window had been wound down and the driver was looking at us.

31. Azilah then informed me they would be taking Aminah away. I informed Aminah they were arresting her. The other two persons then got out of the red proton and exchanged seats so that Lance Corporal Rohaniza and Aminah were in the back while the two men were in the front. They drove off and that is the last I ever saw of Aminah.

32. Abdul Razak Baginda was not at home when all this occurred.

33. After the 19.10.2006, I continued to work for Abdul Razak Baginda at his house in Damansara Heights from 7.00 p.m. to 8.00 a.m. the next morning, as he had been receiving threatening text messages from a woman called ‘Amy’ who was apparently ‘Aminah’s’ cousin in Mongolia.

34. On the night of the 20.10.2006, both of Aminah’s girl friends turned up at Abdul Razak Baginda’s house enquiring where Aminah was. I informed them she had been arrested the night before.

35. A couple of nights later, these two Mongolian girls, Mr. Ang and another Mongolian girl called ‘Amy’ turned up at Abdul Razak Baginda’s house looking for Aminah as they appeared to be convinced she was being held in the house.

36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi Police Station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.

37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling handphone and I was to pass the phone to the Inspector from Dang Wangi Police Station.

38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi Inspector. The conversation lasted 3 – 4 minutes after which he told the girls to disperse and to go to see him the next day.

39. On or about the 24.10.2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields police station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.

40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah’s disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.

41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the Criminal division, Brickfields police station, and that Idris had referred him to ASP Tonny.

42. When Abdul Razak Baginda had lodged his police report at Brickfields police station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumb drive. I know that this was not done as ASP Tonny told me.

43. However ASP Tonny asked me the next day to provide my statement instead and so I did.

44. I stopped working for Abdul Razak Baginda on the 26.10.2006 as this was the day he left for Hong Kong on his own.

45. In mid November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah’s case. When I arrived there I was immediately arrested under S.506 of the Penal Code for Criminal intimidation.

46. I was then placed in the lock up and remanded for 5 days. On the third day I was released on police bail.

47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under S.302 of the Penal Code for murder. I was put in the lock up and remanded for 7 days.

48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on the 19.10.2006 which read “delay her until my man arrives”. They had apparently retrieved this message from Abdul Razak Baginda’s handphone.

49. They then proceeded to record my statement from 8.30 a.m. to 6.00 p.m. everyday for 7 consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Datuk Seri Najib Tun Razak but when I came to sign my statement, these details had been left out.

50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah’s relationship with Datuk Seri Najib Tun Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Datuk Seri Najib Razak and/or his wife.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30 a.m. Abdul Razak Baginda informed us that he had sent Datuk Seri Najib Tun Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30 a.m., Abdul Razak Baginda received an SMS from Datuk Seri Najib Tun Razak and showed, this message to both myself and his lawyer. This message read as follows :- “ I am seeing IGP at 11.00 a.m. today …… matter will be solved … be cool”.

53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.

54. The purpose of this Statutory declaration is to :-

54.1 State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaaribuu.
54.2 Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the 3 accused who must have played a role in the murder of Altantuya Shaaribuu.
54.3 Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the Court prior to submissions at the end of the prosecutions case.
54.4 Emphasize the fact that having been a member of the Royal Malaysian Police Force for 17 years I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.
54.5. Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.
55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

Abbas office criticizes Malaysia premier visit to Gaza

RAMALLAH (Ma’an) — The office of President Mahmoud Abbas on Tuesday criticized a visit by Malaysian premier Muhammad Najib Abdul Razak to the Gaza Strip, Palestinian Authority media reported.

Abbas’ office said in a statement that the Malaysian prime minister’s visit to the Hamas-run enclave harmed the legitimate representative of the Palestinian people and enhanced division, Wafa reported.

“This visit also serves plans to keep Jerusalem segregated from the state of Palestine which the whole world recognized on Nov. 29, 2012,” the president’s office said.

The Malaysian premier telephoned Abbas and said he would ship humanitarian aid to the Gaza Strip and the West Bank, and would meet the president in Cairo, the statement added.

Abdul Razak arrived Tuesday in Gaza via the Rafah crossing, accompanied by his wife, and was welcomed by a Hamas delegation led by Gaza premier Ismail Haniyeh.

The Malaysian premier held a brief press conference, praising the Palestinian people for enduring Israel’s oppression and urging Palestinian factions to unite.

“We believe in the struggle of the Palestinian people. They have been suppressed and oppressed for so long,” Najib told reporters as he was greeted by officials from Gaza’s Hamas government.

“We may be far from you in distance, but we are one nation and believe in the struggle of the Palestinian people,” he added.

Haniyeh thanked the government and people of Malaysia for their support for the Palestinian people.

Abdul Razak visited a Gaza university and government offices, as well as the family of top Hamas military chief Ahmed al-Jaabari, whose assassination by Israel in November started an eight-day war in which more than 160 Palestinians and six Israelis died.

He was expected to open several projects in Gaza, and will lay a foundation stone for the Gaza government’s cabinet building, which was destroyed during Israel’s November assault.

In October last year, the emir of Qatar made a historic visit to the Gaza Strip, the first head of state to enter Gaza since 1999.

Gaza’s Hamas rulers said the visit by Sheikh Hamad bin Khalifa al-Thani had broken the Israeli siege, and Palestinians lined the street to welcome the emir.

Mahathir Biadap, Buta Sejarah- Prof Dr Aziz Bari

Kenyataan Tun Dr Mahathir Mohamad bahawa Tunku Abdul Rahman Putra Al Haj memberi kewarganegaraan kepada pendatang asing, menerima kecaman pelbagai pihak termasuk pakar perlembagaan, Profesor Dr Abdul Aziz Bari.

Menyifatkan kenyataan itu biadap dan mengarut, Aziz berkata, kewarganegaraan yang diberi oleh bapa kemerdekaan itu berbeza ketika Mahathir berkuasa sebagai perdana menteri.

“Tunku beri kewarganegaraan bukan dengan tujuan menipu pilihan raya. Apa yang Tunku buat sebahagian tuntutan dan persetujuan kemerdekaan. Ada syarat tertentu yang diakui undang-undang sebagaimana negara-negara lain,”

“Mereka tidak datang ke sini sebagaimana Pendatang Tanpa Izin (PATI) sekarang, tetapi kesan pentadbiran British. Faktor menipu dalam pilihan raya, tidak ada dalam kes Tunku,”

“Tunku mengenakan syarat tertentu yang sebahagiannya dimasukkan dalam peruntukan perlembagaan. Ia dilakukan secara terbuka, bukan mencuri-curi dan berselindung sebagaimana Mahathir,” ujarnya dalam satu kiriman emel kepada Keadilan Daily.

“Mahathir bukan sahaja biadab dan buta sejarah, tetapi mempersoalkan kedudukan orang Cina dan India yang diakui oleh perlembagaan,” tambah beliau.

Menurut pakar undang-undang ini, berbeza di zaman Tunku, kerakyatan diberi berasaskan kontrak sosial, dan syarat kewarganegaraan pula menjamin kedudukan istimewa orang Melayu.

“Kedudukan dan kuasa Majlis Raja-Raja juga diperkuatkan oleh isu tersebut. Ertinya, tolak ansur antara Melayu dan bangsa lain ketika kemerdekaan dirundingkan.

“Ia diperincikan dengan jelas oleh Bahagian III Perlembagaan Persekutuan dan jadual yang berkenaan. Perkara ini juga perlu dipantau oleh Majlis Raja-Raja,” tambah bekas Pensyarah Undang-undang Universiti Islam Antarabangsa (UIAM) ini.

Ketika ditanya sama ada kerakyatan diberi Tunku selepas merdeka sah mengikut perlembagaan, beliau berkata “Soal lama atau baru tak timbul; ia boleh diberi kepada sesiapa pun. Yang penting ia mengikut prosedur ditetapkan perlembagaan.

“Tidak timbul ia diberi selepas merdeka asalkan ia mengikut prosedur berkenaan dan telus. Almarhum Prof Ahmad Ibrahim (seorang ahli politik Singapura) sendiri pun jadi warga Malaysia selepas merdeka. Beliau orang Singapura. Perkara ini berlaku di seluruh dunia,” tegas Aziz.

“Namun apa yang menjadi masalah dengan Mahathir adalah kewarganegaraan diberi secara borong, ribuan dan secara sembunyi.

“Seperti yang kita tahu dia sendiri nafikan sebelum ini. Baru sekarang setelah semua orang bercakap dan Suruhanjaya Siasatan Diraja (RCI) ditubuhkan, baru lah Mahathir mengaku. Tetapi seperti biasa, dia akan seret orang lain seperti Tunku,” ujarnya yang turut menyentuh isu itu dalam bukunya, Malaysian Constitution: A Critical Introduction.

UMNO dan Impian 2/3 Kerusi Parlimen…

 

Kita biarkan Ahmad Maslan dan mana2 pemimpin UMNO merasakan mereka akan menang 2/3 kerusi parlimen. Kita tidak boleh lawan orang UMNO dalam bab cakap besar. Anwar Ibrahim pun kalah jika berlawan siapa boleh menjerit lagi kuat dengan Najib Razak.
Perasaan itu semua dalam alam angan2 orang UMNO belaka. Di Sabah BN ada potensi untuk hilang 17 kerusi parlimen. Semua kerusi dimana kombinasi China dan Kadazan majority- UMNO dan BN akan kalah. Di Sarawak PBB ada 14 kerusi parlimen. Parti2 bukan PBB ada 16 dan pembangkang ada 1. BN boleh hilang 17 kerusi di Sarawak. jadi di Malaysia Timur, UMNO bakal hilang sehingga 33 kerusi parlimen.

Jika mereka kalah 33 kerusi, kiamat akan tiba awal untuk UMNO

Di Semenanjung UMNO ada 66 kerusi sahaja. Dicampur dengan 13 dari Sabah, UMNO ada 79 kerusi. Di Semenanjung, UMNO nak kekalkan 66 kerusi pun sesak dan tenat. UMNO sekarang bukan macam UMNO dahulu. Pembangkang sekarang bukan macam pembangkang dahulu. Dulu UMNO kuat, sekarang lemah. Dahulu Pembangkang lemah, sekarang bertambah kuat dan bersatu.

In 2008, calun UMNO hanya dapat 2 juta undi dari 5.7 juta pengundi Melayu. Ahli UMNO jumlah nya 3.2 juta. Itu bermakna 1.2 juta ahli UMNO, walaupun UMNO mengundi calun PR. Jumlah pengundi dalam tahun 2008 ialah 7.9 juta. Kali ini, ada tambahan 2.5 juta pengundi kebanyakan nya orang muda. 70-80% orang muda tidak akan undi BN dan UMNO.

Jadi kita biarkan panglima2 UMNO mengimpikan 2/3 kerusi parlimen. Di Sabah kali ini mereka akan kalah teruk. Budak kecik dan orang tua, lelaki dan perempuan menzikirkan inikalilah setiap kali. Rakyat di pedalaman pun sudah bernekad undi PR atau kalau mereka tidak tahu nama parti, mereka hendak undi Anwar Ibrahim. bab kita suka atau tidak Anwar Ibrahim adalah suatu hal yang lain. Kalau rakyat percaya kepada dia, tidak ada siapa yang boleh buat apa apa. Tidak saya, saudara, Najib atau Mahathir.

Mahathir jangan lupa, Pak Lah dalam tahun 2004 mendapat mandate dan jumlah undi yang paling besar. Pencapaian itu tidak pernah perolehi oleh Mahathir pun. Mahathir jangan lupa bahawa mandate yang besar tersebut bukan diperolehi kerana orang sukakan Pak Lah- tapi mandate tersebut diberi kerana rakyat meraikan pengunduran Mahathir. jadi, kalau Mahathir menghulurkan hidung dia dalam PRU yang akan datang, rakyat akan sekali lagi meraikan pengenyahan Mahathir. rakyat Sabah nanti lama untuk menyuarakan hak mereka menyatakan amarah keatas Mahathir sebagai akitek projek IC.

Ada finah yang ditabur oleh puak UMNO menyatakan Dato Fauzi Shaari menyesal masuk PAS. Saya sudah banyak kali berceramah dengan Dato Fauzi semenjak dia mula2 berceramah lagi. Semangat nya untuk mewakili PAS dalam parlimen Larut semakin berkobar kobar setiap hari. Dia bukan menyesal, bahkan menyesali kenapa lama sangat tidak memilih PAS. Kita doakan dia berjaya dalam PRU ke 13 nanti. Ramai anggota polis menyokong pendirian Dato Fauzi dan mereka akan sokong PR ditempat tempat mereka.

Apabila kes RM40 juta timbul , Musa Aman berada dalam ketakutan yang amat sangat. Memang itu duit ufti yang dibayar oleh peniaga balak di Sabah kepada Musa. Bila kes ini tersebar- Musa Aman menangis. Dia rasa dia akan kena jel kali ini. dia sedar ada kumpulan di Kuala Lumpur berkonspirasi mahu menjatuhkan nya dari menjadi KM Sabah. jatuh atau tidak, tidak menjadi masaalah kepada kita. Musa Aman akan kalah banyak kerusi parlimen kali ini. bahkan Anifah Aman sudah pun bersedia untuk menubuhkan parti politik baru diSabah untuk menentang komplot politik geng2 Najib dari KL.

Tapi Musa Aman pandai berpolitik. Dia ambil duit dari mana2 sumber yang dia boleh. Tapi dia agihkan kepada semua calun parlimen dan adun BN. setiap orang menerima RM1 juta. Dan Musa ketika menyerahkan apa2 wang kepada mamat2 BN akan mengkehendaki mereka sain baucer menerima wang. Jadi dia ada senarai yang lengkap siapa terima dan terima banyak mana.

Bila Musa jumpa Najib di KL- dia berkata. You tidak beri saya apa2 bila berdepan dengan PRU. I finance everything. 25 parlimen ertinya, saya beri RM25 juta. 60 kerusi DUN, bererti saya telah belanja RM 60 juta. Jadi total semua RM85 juta. This is the record of the recipents. Jadi kalau saya terima RM40 juta, tak sampai separuh saya recoup belanja saya. Bukan untuk saya, untuk calun BN. itu tak termasuk kos dan belanja logistics yang lain. So if you want to pin me on the RM40 million, you must also charge all the BN MPs and ADUNs.

Najib tak tahu nak buat apa2. Nak ambil tindakan kat Musa, nanti semua rahsia bocor. Mahu tak mahu, Nazri Aziz keluar kenyataan- RM40 juta itu Ahmad Albab UMNO yang punya.

Kalau benar BN itu telus, kenapa takut isytihar harta?

 

Kecelaruan yang negara alami kini, bukannya kerana masalah yang disebabkan oleh rakyat sebenarnya. Masalah yang ada pada hari ini adalah masalah yang disebabkan oleh pemimpin-pemimpin kita. Rakyat tidak memberi masalah kepada kerajaan. Sebaliknya kerajaan dan pimpinanlah yang memberikan masalah kepada rakyat sehinggakan rakyat sudah berang di dalam hati mereka yang menyebabkan mereka mempersoalkan segala tindak-tanduk pimpinan dan parti yang memerintah negara kita sekarang ini.

Isu yang terbesar di dalam negara kini ialah rasuah yang menyebabkan sistem kerajaan sekarang hampir lumpuh kalau kita sandarkan penilaian kita dengan negara-negara maju. Rasuah ini dilakukan oleh pemimpin-pemimpin justeru itu telah menyebabkan banyak perkara yang tidak betul lagi berlaku di hadapan mata rakyat.

Saya tertarik dengan cadangan Lim Guan Eng, Setiausaha Agong DAP, yang telah pun melakukan usaha yang bertanggungjawab mematikan budaya rasuah di negeri Pulau Pinang yang beliau tadbir. Beliau mencadangkan beberapa cara untuk menghapuskan rasuah seperti yang beliau sendiri telah lakukan di Pulau Pinang sejak beliau mentadbir negeri itu.

Di antaranya setiap ahli-ahli Pentadbir Negeri dari exco kerajaan serta pegawai pelaksana mengisytiharkan harta mereka. Mereka dikehendaki mengisytiharkan harta mereka termasuk akaun bank mereka di dalam dan di luar negara. Cara ini amat penting dilakukan kerana rakyat yang telah memberikan mereka mandat mahukan mereka mentadbir dengan bersih dan menghilangkan keraguan tentang kebersihan mereka menjaga harta benda rakyat.

Cadangan yang lainnya ialah memastikan tidak ada ahli keluarga pemerintah yang terlibat dengan kontrak kerajaan dan ini merupakan satu cadangan yang sepatutnya sudah lama dilaksanakan oleh BN tetapi tidak dilakukan. Etika ini memang menjadi pakaian di negara negara maju di dunia ini. Tetapi di negara ini pemimpin-pemimpin kita tidak termampu untuk melakukannya kerana kedudukan mereka itu merupakan modal perniagaan bagi mereka dan keluarga serta kroni-kroni mereka.

Seperti yang dicadangkan oleh Lim Guan Eng pengisytiharan aset semestinya di‘institutionalized’kan kerana ia merupakan elemen yang terpenting dalam menjaga intergiti sesuatu kerajaan itu. Ini pun yang dilakukan oleh kerajaan negara-negara maju dan kebaikan amalan ini sepatutnya menjadi ikutan kita kerana ia adalah cara yang terbaik untuk menjaga rakyat dan negara. LGE telah memperkuatkan tindakan pengisytiharan harta ini dengan membuat pengesahan dari ‘akauntan bertauliah’ yang tidak boleh dipersoalkan kredibilti mereka.

Tetapi kalau kita hendak meniru dan menjadikan negara-negara mundur di Afrika seperti Zimbabwe dan sebagainya Najib dan BN tidak payah untuk bergegar-gegar berucap dan beretorik untuk menjadikan negara ini sebagai negara maju menjelangnya tahun 2020. Tidak mungkin negara kita akan menjadi negara maju sedangkan kita masih terhambat oleh mentaliti politik dan kerajaan dunia ketiga. Tidak mungkin kita akan menjadi rakyat negara maju jika mentaliti kita masing masing berunsurkan mentaliti dunia ketiga.

Saya pernah diberitahu oleh rakan yang pernah duduk di dalam kabinet kerajaan hari ini yang ramai di antara menteri-menteri kita tidak bersetuju untuk mengisytiharkan harta benda mereka kepada umum. Sebab yang menyebabkan mereka tidak mahu mengisytiharkan harta mereka itu bukanlah susah untuk difahami. Sebabnya tidak lain dan tidak bukan ialah kerana mereka tidak mahu diketahui umum tentang cara dan bagaimana mereka boleh melonggokkan sejumlah harta yang begitu banyak dengan rumah-rumah mewah, kereta mewah dan segala-galanya mewah.

Itu sebabnya selalu saya katakan rasuah sentiasa tidak membenarkan kita melakukan kebaikan kerana melakukan kebaikan itu akan menyekat masa depan perasuah negara. Kadang-kadang kita tidak memahami kenapa begitu degil dan payah sangat bagi pimpinan kita untuk melakukan kerja yang baik dan menjadi amalan di dalam negara-negara maju.

Sekarang kita mempunyai barisan pemimpin yang tidak mahu mengisytiharkan harta mereka di dalam dan di luar negara kerana mereka mendapatkan semua wang ringgit yang besar itu melalui kedudukan mereka di dalam kerajaan, dan itu adalah cara rasuah.

Pengistiharan harta ini tidak mungkin boleh berlaku selagi barisan pimpinan ini menerajui kita dan selagi mereka boleh melakukannya rasuah ini tidak akan berhenti kerana seperti yang saya sebutkan rasuah ini merupakan ketagihan oleh pimpinan kita. Seperti penagih dadah, penagih rasuah juga tidak akan aman hidup mereka tanpa melakukan rasuah.

Oleh itu kita perlu melakukan sesuatu untuk rakyat Malaysia setanding dengan negara-negara maju dalam mana rakyatnya hanya memilih kerajaan yang bersih dan ‘sustainable’ kebersihan daripada rasuah ini. Untuk menjadikan negara kita sebagai negara maju, sikap dan nilai, dan persepsi kita terhadap keterbukaan ini amat penting diperbetulkan.

Beberapa cadangan yang diutarakan oleh Lim Guan Eng itu sememangnya senang dilakukan jika semua pihak jujur dan ikhlas untuk melihat negara kita ditadbir oleh pimpinan yang bersih dan beretika. LGE sendiri sedang melaksanakannya dan tidak nampak kenapa pimpinan kerajaan persekutuan dan kerajaan negeri-negeri tadbiran BN tidak mahu melakukannya. Malahan apa yang dilakukan oleh LGE ini tidak digemari oleh BN kerana BN sememangnya tidak senang kerana rakyat telah nampak apa yang baik yang ada jika PR mentadbir negeri dan negara kita.

Tidak ada sebab langsung. Tetapi jika ada sebabnya ia tidak lain dan tidak bukan, ialah kerana mereka tidak mahu terbongkar segala kegiatan yang berunsur rasuah dan salahguna kuasa. LGE dan kerajaan negeri yang ditadbir oleh PR telah pun melakukannya. Bila pula kerajaan Persekutuan dan kerajaan-kerajaan negeri-negari tadbiran BN pula mahu melakukannya? Dalam isu ini sahaja sudah cukup untuk membuktikan yang rakyat masih ada harapan untuk melihat negara kita dapat diselamatkan daripada bankrap dan kejatuhan tamadunnya.

Jika peluang dan harapan ini tidak diambil kesempatan oleh rakyat maka rakyat tidak boleh lagi menyalahkan sesiapa selepas ini. Rakyat masih boleh melakukan usaha-usaha menyelamatkan negara kita daripada dirompak dan menjadi mangsa oleh pemimpin-pemimpin yang sudah ketagihan rasuah ini. Harapan rakyat ini hanya boleh dilakukan dengan meninggalkan yang buruk dan pergi ke arah kebaikan. Rakyat telah pun nampak di mana dan bagaimana untuk mendapatkan kebaikan itu. Berfikir dan lakukannya dengan baik dan terhormat.

Tentulah kebaikan itu akan mula kita perolehi dalam pilihanraya yang akan datang ini. Jangan was-was kerana sikap was-was ini merupakan sikap yang terkeji.
